Terms of Sale

1. Parties

The website www.vikingfootwear.com (the “Website”) is a site operated by Viking Outdoor Footwear AS, (the “Seller”), whose registered address is at Brynsveien 16b, 0667 Oslo, Norway, reg.number 992 933 348. The Seller’s VAT number is 992 933 348MVA. The buyer is the person stated as buyer in the Order (the “Buyer”). The Seller supplies the products (“Products”) listed on the Website.

These conditions of sale constitute, together with the Order and the Order Confirmation, the total contractual basis for the purchase (the “Agreement”). They apply to purchases made by consumers only.

2. Prices

The prices referred to in the Website include VAT but exclude delivery costs. Information about the total amount to be paid by the Buyer, including environmental fees, where relevant, and all other fees and delivery costs, and the purchase specification of each element of the total price, is given in the order (“Order”) before payment is made. In the case of an information error including pricing The Seller reserves the right to cancel an order. The Buyer will be notified promptly, and any payment made will be refunded in full.

3. Entering into the agreement

The Seller will acknowledge receipt of the Order electronically. All Orders are subject to acceptance by the Seller. As the acknowledgement of receipt is not acceptance of the Order, the Seller will confirm such acceptance to the Buyer by sending an e-mail that confirms that the Product has been dispatched (the “Order Confirmation”). The Buyer shall review the Order Confirmation for any non-compliance with the Order both in terms of numbers, type of Product, price etc. Any discrepancy between the Order and the Order Confirmation shall be reported to the Seller as soon as reasonably possible either by filling out the contact form on https://vikingfootwear.com/customer-support or by calling the Seller on +47 22 07 24 00. Once the order has been placed by the Buyer, the Seller is unable to amend, change delivery address or cancel the order. The Buyer must review their order carefully before it is placed. This restriction does not affect the Buyer’s statutory right of withdrawal, which is set out in section 7.

To the extent permitted by law, the Seller cannot be held liable for and is not bound by writing or typing errors occurring in the communication with the Buyer.

Where the Product is out of stock, the Seller may offer the Buyer information about alternative Products.

In order to be able to shop at the Website, the Buyer must be over 18, legally capable of entering into binding contracts and acting in his/her personal capacity and not in the course of trade. The Seller reserves the right to cancel Orders made by Buyers acting in the course of trade.

4. Payment

The Seller accepts payment from the available payment option selected by the Buyer. The payment options available to the Buyer will depend on the delivery country of the Buyer. The Seller will charge the debit or credit card of the Buyer once an Order has been dispatched. The Seller may decline an Order if a payment is declined by the debit or credit card of the Buyer. Please note, the bank of the Buyer may charge a fee or charge to complete the payment. The Seller has no control over these bank fees or charges, and the Buyer is solely responsible for paying any such bank fee or charge.

6. Ownership of the product

Ownership of the Product passes to the Buyer only once full payment has been received by the Seller. If the time of delivery has arrived and the Buyer fails to have the Product delivered to him after the Product is made available to the Buyer, the Buyer will be responsible for any loss of or damage to the Product.

7. Right of Withdrawal, Cancellation and Returns

Statutory Right of Withdrawal (Angrerett):

As a consumer, the Buyer has a statutory right of withdrawal under the Norwegian Right of Withdrawal Act (angrerettloven), which implements EU Directive 2011/83/EU on consumer rights. This right applies to purchases made at a distance through the Website by consumers in Norway and the EU/EEA. It is separate from, and in addition to, the Seller’s voluntary 30-day return policy described below.

The Buyer may withdraw from the Agreement within 14 calendar days without giving any reason. The withdrawal period expires 14 calendar days from the day after the Buyer, or a third party nominated by the Buyer (other than the carrier), takes physical possession of the Product. Where several Products ordered in one Order are delivered separately, the period runs from the day after the last Product is received. The Buyer may also withdraw at any time before the Product is delivered.

To exercise the right of withdrawal, the Buyer must inform the Seller of the decision by a clear statement before the period expires. The Buyer can do this through the withdrawal page (also linked in the footer of the Website), by completing the standard withdrawal form (angreskjema) made available to the Buyer, or by any other unequivocal statement, for example an email to webshop@vikingfootwear.com. To meet the deadline, it is enough that the Buyer sends notice of the withdrawal before the period has expired. The burden of proving that the right of withdrawal was exercised in time rests with the Buyer.

If the Buyer withdraws, the Seller will refund all payments received from the Buyer, including the cost of standard delivery, without undue delay and no later than 14 calendar days from the day the Seller is informed of the decision to withdraw. The Seller will use the same means of payment the Buyer used for the original transaction, unless the Buyer expressly agrees otherwise. The Seller may withhold the refund until the Product has been received back, or until the Buyer has supplied evidence of having returned the Product, whichever is earlier.

The Buyer must return the Product without undue delay and no later than 14 calendar days from the day the Buyer notified the Seller of the withdrawal. The Seller will bear the direct cost of returning the Product, provided the Buyer follows the return instructions. The Buyer may handle and inspect the Product only as would be permitted in a physical store, that is, to establish its nature, characteristics, and functioning. The Buyer may be liable for any reduction in the value of the Product resulting from handling beyond what is necessary for that purpose.

Some Products are exempt from the right of withdrawal under the angrerettloven, including Products made to the Buyer’s specifications or clearly personalized, and sealed Products that are not suitable for return for health or hygiene reasons where they have been unsealed after delivery. Where an exception applies, this will be stated before the Buyer completes the Order. If the Seller has failed to inform the Buyer of the right of withdrawal, the withdrawal period is extended by up to 12 months in line with the angrerettloven.

The Seller reserves the right to not accept an order from the Buyer. The Buyer may cancel the purchase of the Product at any time for any or no reason within 14 calendar days, beginning on the day after he/she received the Product. The right of withdrawal may be exercised even if the Product is free from defects and either before or after the Product has been delivered. Where the Product has been delivered and the Buyer wants to cancel the purchase, the Buyer must return the Product to the Seller. The Seller will bear the costs of returning the Product and will refund the price paid. When the Buyer returns a Product to the Seller because the Buyer has withdrawn from the Agreement in accordance with this section 7, the Seller will process the refund due to the Buyer as soon as possible and, in any case, no later than 14 days from the date the Seller is informed of the Buyer’s decision to exercise the right of withdrawal. However, the Seller may withhold the refund until the product has been received, or until the Buyer has provided documentation confirming that the product has been returned. The Buyer’s right of withdrawal is conditional upon the Product and its packaging being in the same condition as when received. Original packaging, labels and protective marketings must remain intact. The Buyer reserves the right to open and examine the Product with due care to determine its nature, characteristics and functioning. The refund will be made using the same means of payment as used by the Buyer, unless otherwise expressly agreed.

Return Policy:

The Seller offers a 30-day return policy

In addition to the statutory right of cancellation, the Seller offers a 30-day return period for unused products in their original condition and packaging. The Seller will cover the costs associated with returning the Product, provided the Buyer follows the instructions provided for the return. The Seller will issue the Buyer a full refund for the price paid for returned item(s). Once the Product has returned to the warehouse, the Seller requires up to 4 business days to process the refund. Once the refund has been processed, the Buyer will receive an email notification from the Seller. Dependent on the Buyer’s bank’s processing time, it may take 1-3 business days for the funds to appear in the account. In order to purchase a different size or item, the Buyer must place a new order in the Webshop.

If the Buyer wishes to return or make a claim on a Viking Product that was purchased on another website or in a third-party retail store, the Buyer must contact the store or website from which the Product was purchased. Viking Outdoor Footwear cannot accept returns, claims or make reimbursements for any product purchased from another website, or in a third-party retail store.

How to return a product:

All returns must be registered online via the Seller’s return portal, which can be found here.

The Buyer must attach the return label to the outer packaging. The Buyer may not write or attach anything else to the shoe box/bag when returning the Product, or the Buyer runs the risk of the return being refused.

The Buyer must deliver the package where it was collected.

The Buyer is responsible for retaining the return slip in order to track the return. The Seller does not send an email once the return has arrived at the warehouse. An email will only be sent to the Buyer once the return has been processed.

Items may be returned if:

  • The products are unwashed and unused (the Buyer may of course try the Product on for fit)

  • The Product is in its original undamaged packing (a carefully opened package is fine)

  • All tags are attached

  • The Product is complete (e.g. both items of a pair must be returned)

  • The Buyer has kept their proof of postage in case the return is lost in transit

Product not in accordance with order, defective or damaged on delivery:

When the Buyer receives the Product, he/she should examine whether or not the Product is in accordance with the Order and whether the Product has been damaged during transport or whether the Product suffers from defects. If the Product is not in accordance with the Order, has been damaged during transport or suffers from defects, the Buyer must give notice to the Seller in accordance with section 9. The Seller will refund or replace Products which are damaged, defective or not in accordance with the Order on delivery.

Claims in the event of defects of the product after delivery

If at any time after delivery the Product is found to be defective, the Buyer must, within reasonable time after the Buyer became aware of the defect, send a notice to the Seller of the defect. This must be done no later than 14 days from when the defect was discovered by the Buyer. If the product is purchased on Vikingfootwear.com, the Buyer must register their claim here. The Seller does not handle products purchased from other retailers. These requests should be directed to the retailer from whom the Product was purchased. If the Product is defective, the Buyer must return the defective Product to the Seller. The Seller shall bear the costs of returning the Product and will refund or replace the defective Products. Warranty vouchers are time limited. For questions regarding claims or anything else, contact us via email (webshop@vikingfootwear.com) or phone (+47 22072400).
